NeuroDay Privacy Policy

NeuroDay ("NeuroDay," "we," "us," or "our") is a nonprofit organization that provides a mobile application offering visual schedules, visual timers, and calming transition sounds for autistic individuals and people with related developmental differences. This Privacy Policy explains how NeuroDay handles information in connection with the NeuroDay app (the "App") and our website.

We designed NeuroDay from the ground up to collect as little information as possible — and to comply fully with the Children's Online Privacy Protection Act ("COPPA") — because many of our users are children.

1. Summary: Privacy by Design

NeuroDay is built as a fully offline application. This is a deliberate design choice, not an afterthought:

  • No account creation. You do not create a username, password, or profile with NeuroDay, Inc. to use the App.

  • No cloud storage. Schedules, photos, timer settings, and sound preferences are stored only on your device. NeuroDay does not operate servers that receive, store, or process your child's photos, schedules, or any other personal content.

  • No analytics or tracking. The App does not use third-party analytics SDKs, advertising identifiers, or behavioral tracking of any kind.

  • No advertising. NeuroDay contains no ads and shares no information with ad networks, because there are none integrated into the App.

  • No data sale. We do not sell, rent, or trade personal information, because we do not collect it in the first place.

Because the App does not transmit personal information to NeuroDay or any third party, most traditional "data collection" sections of a privacy policy do not apply to NeuroDay's core app functionality. Sections below explain the limited exceptions (such as optional donation or contact forms on our website) and how we meet our obligations under COPPA regardless.

2. Information We Do NOT Collect Through the App

The App does not collect, transmit, or have any technical ability to access:

  • Children's names, photos, or images uploaded to build visual schedules (these remain on the device)

  • Location data

  • Contact lists

  • Camera roll contents

  • Device identifiers used for tracking or advertising

  • Usage analytics, session data, or behavioral profiles

  • Any information transmitted to NeuroDay's servers, because the App does not require or use an internet connection to function

Any photo a parent, caregiver, or educator adds to a schedule is written to that device's local storage using standard iOS/Android app-sandboxing protections. It is never uploaded to NeuroDay, and NeuroDay has no access to it.

3. Sharing Between Home, School, and Therapy

NeuroDay allows a caregiver to export a schedule file (for example, to share the same routine between home and school) using the device's native share sheet — such as AirDrop, email, or messaging apps the caregiver already has installed. When a caregiver uses this feature:

  • The export/import happens directly between the caregiver's chosen apps and devices.

  • NeuroDay does not operate, host, or have visibility into this transfer.

  • Responsibility for choosing a secure sharing method (e.g., a private message rather than a public post) rests with the caregiver, the same as sharing any other file from their device.

4. Our Website and Optional Contact/Donation Forms

Separate from the App itself, NeuroDay's website may include:

  • A contact form, which collects the name and email address a visitor voluntarily provides in order to respond to their inquiry.

  • A donation, processed through a third-party, PCI-compliant payment processor (Squarespace), which collects payment and billing information necessary to process the transaction. NeuroDay does not store full payment card numbers.

These website forms are intended for use by parents, caregivers, educators, clinicians, and other adults — not for direct use by children. We do not knowingly collect personal information directly from children under 13 through our website donation, contact, or code-request forms.

5. Our COPPA Commitment

Because NeuroDay is intended for use by and on behalf of children under 13, we comply with COPPA as follows:

a. No collection of children's personal information. COPPA regulates the online collection of personal information from children. Since the App does not transmit any personal information — including photos, schedules, or identifiers — to NeuroDay or any third party, NeuroDay does not "collect" personal information from children within the meaning of COPPA through the App's core functionality.

b. Parental notice. This Privacy Policy serves as notice to parents and caregivers of our data practices before download and use of the App.

c. No third-party data sharing. NeuroDay does not share, disclose, or make available any child's information to third parties, because such information is never transmitted to us.

d. Parental control by design. Because all schedules, photos, and settings remain on the family's own device, parents retain complete control over their child's information at all times — including the ability to delete any photo, schedule, or the entire App at will, with no need to contact NeuroDay to "delete an account" (since none exists).

e. No conditioning of use. NeuroDay does not condition a child's participation in any activity on the disclosure of more personal information than is reasonably necessary for that activity, consistent with COPPA's data minimization principle. In NeuroDay's case, the App requires no personal information disclosure to NeuroDay at all.

f. Verifiable parental consent. Because the App does not collect personal information from children that is transmitted off-device, NeuroDay does not require verifiable parental consent under COPPA for use of the App itself. If a future version of NeuroDay introduces any feature that would collect or transmit a child's personal information off-device, we will update this policy and implement COPPA-compliant verifiable parental consent mechanisms before that feature is enabled.

g. Direct notice to parents where applicable. If NeuroDay ever introduces optional cloud-based features (for example, an optional backup feature), such features will be off by default, clearly disclosed, and will require a parent or caregiver — not a child — to affirmatively opt in after receiving direct notice of what will be collected and why.

6. Data Security

Because information stays on the user's own device, security depends primarily on the device's own protections (such as the phone or tablet's passcode, biometric lock, and operating-system sandboxing). We recommend caregivers:

  • Use a device passcode or biometric lock, particularly on shared or school devices.

  • Use NeuroDay's caregiver-mode lock feature to prevent a child from exiting into device settings or other apps.

  • Take care when exporting or sharing schedule files to only send them to trusted recipients.

For the limited data collected through our website (Section 4), we use industry-standard safeguards, including encrypted transmission (HTTPS/TLS) and reputable, PCI-compliant payment processors.

7. Children's Photos and Sensitive Content

We recognize that photos used in visual schedules (a child's bathroom, classroom, teacher, or caregiver) can be especially sensitive. NeuroDay's offline-first architecture exists specifically so that this content never has to leave the family, caregiver, therapist, or educator's own device to make the App useful.

8. Your Rights and Choices

Because NeuroDay does not hold personal information collected through the App, there is generally no "your data" for us to return, correct, or delete — it already lives solely on your device, under your control.

For the limited information NeuroDay does hold (contact form submissions, donation records, hardship code requests submitted through our website), you may:

  • Request a copy of the information you provided,

  • Request correction of inaccurate information, or

  • Request deletion of your information,

by contacting us using the details in Section 11 below.

9. Nonprofit Status and Use of Information

NeuroDay is a registered Ohio nonprofit corporation & federal 501(c)(3) tax-exempt status. Any information collected through donation or contact forms is used solely to further our charitable mission — including processing donations, issuing discounted codes, and responding to inquiries. We do not sell or rent this information to third parties for marketing purposes.

10. Changes to This Policy

If we make material changes to this Privacy Policy — for example, if we introduce an optional feature that changes how information is collected — we will update the "Last Updated" date above and, where the change affects children's information, provide direct notice through the App and/or our website prior to the change taking effect.

11. Additional Notice for Residents of California and Other States

Some states (including California, Virginia, Colorado, Connecticut, and others) have enacted comprehensive privacy laws that give residents additional rights regarding personal information, such as the right to know, delete, or opt out of the sale/sharing of personal information. Because NeuroDay's App does not collect personal information from users and our website collects only the limited, voluntarily-provided information described in Section 4, we do not sell or share personal information as defined under these laws. Residents of these states who have questions about their rights, or who wish to make a request regarding information submitted through our website, may contact us using the details in Section 12 below.

12. Accessibility

NeuroDay is built to serve people with disabilities, and we are committed to making our website and App accessible in line with the Web Content Accessibility Guidelines (WCAG). If you encounter an accessibility barrier using our website or App, please let us know using the contact details below so we can address it.
